Injury Liability and Damage Liability - 25 Sep 2009 11:54

Car insurance is often a confusing subject for many a policyholder with all the jargon that seems more to act as a distraction than be informative. Bodily injury liability and property damage liability clauses, depending on the insurer, are inserted into motor insurance policies to explain the liability when physical injury or damage to property is the result of an accident.

Bodily Injury Liability
The liability of injury resulting from an accident belongs to the person responsible for causing the accident. Such liability ordinarily is compensated for by the guilty party to third parties which is covered in the bodily injury liability cover section of your policy. While insurers would then cover the medical expenses of those parties on behalf of the at fault driver.

South Africans are usually relieved of this as a result of the Road Accident Fund (RAF). The RAF covers any injuries resulting from road accidents which all drivers contribute to as part of their fuel levy calculated into the price of our fuel. Drivers, though, who are involved in an accident while under the influence or caused an accident while breaking the law can be rejected by the RAF which makes bodily injury liability cover null and void.

Property Damage Liability
Often referred to as third party liability, property damage liability refers to damage to third parties property, usually a vehicle. The person who caused the accident is liable to the other party for all the damages to property caused as a result of the accident. If you decide not to buy insurance because your car is cheap to fix or replace, you might want to take out limited liability or third party liability insurance just in case the other car is an M3.
